How Will the NAR lawsuit and settlement Affect You?

  • At this time, the buyer brokerage cooperative commission is offered by the listing brokerage and displayed on the Multiple Listing Service
  • Pending a judge's approval, new rules will prohibit listing agents and brokers from offering buyer agent compensation on the Multiple Listing Service
  • This does not mean listing brokerages cannot offer buyer agent compensation
  • New rules, expected in mid-August 2024, require buyer broker agreements prior to agents showing properties to buyers
  • Buyer broker agreements must include a beginning and end date and the buyer agent compensation
  • Compensation may come from the seller, the listing brokerage, the buyer or a hybrid yet to be determined. 

There is no doubt these changes will make real estate transactions more complex, particularly in the next year.
